These terms and conditions (the Terms) govern your use of this website and your purchase of artworks form me.

By using this website and buying art products from me, you agree to these Terms. If you do not agree with the Terms, do not use this website or buy art from me.

The contract between us:
I must receive the payment of the whole price for the art that you order before your order can be accepted. Once payment has been received I will confirm that your order has been accepted by phone or by sending an email to you at the email address you provided. My email acceptance of your order brings into existence a legally binding contract between us.

Privacy Statement:
I am committed to safeguarding the privacy of all my users while providing the highest possible quality of service. I will only use the information that is collected about you lawfully and in accordance with GDPR regulations.

The data is confidential and will only be used for the purposes for which permission has been granted. I do not share data with any other parties.

Pricing:
I have tried to price the work fairly and to reflect both the initiation of an idea and the time and materials involved in making the work. Price for delivery of anything purchased will be discussed at time of ordering, and where relevant a price for postage with insurance will be given.

Security:
All card details are kept within the PayPal and are not accessible to me.
Payment will be debited from your card before the art will be dispatched. PayPal will issue you with an electronic receipt.

Description of artwork:
Please contact me if you would like to know more about the any of the pieces on my website. Sizing of the some pieces, such as the ceramics, is to their biggest dimension and are not the overall dimensions. The photographs only give a general idea of what the pieces really look like. Each piece is unique and hand-made so, even with the prints, there can be a colour variation across an edition.

Events beyond my control:
Every effort will be made to keep the website up to date and correct. I have no liability to you for any failure to perform any obligation of any contract under these Terms (expressed or implied) where such failure is caused by any event or circumstances beyond my reasonable control including but without limitation to breakdown of systems, flood, fire, explosion, accident or pandemic.

Consumer protection:
These Terms do not affect your statutory rights.

Use of cookies:
Cookies (tiny text files, temporarily stored on your computer) are needed to allow the right item you’ve chosen to be put into the right shopping basket.

Disclosures:

Copyright:
I retain all copyright over ideas and all the objects and artworks. As a purchaser you will own the object, but I will always retain the copyright and the right to use images of the work. I will not disclose who owns individual pieces.

When you decide to either contact me by telephone, mail or email, or to place an order via my online shop, looking after your personal information is extremely important to me and something that I take very seriously.

All websites that collect personal information are now required to conform with a set of regulations, which are part of something called GDPR (General Data Protection Regulation). The regulations basically ensure that I am putting the necessary steps in place ir order to adequately protect your personal information.

Below is an overview of how your personal information will be used and stored when using my website.

How do I collect your personal information?

Information that you provide me

When you contact me via my website contact form, you provide me with the following information:

Your name, email address and any personal information contained within your message

This information is then emailed to me and stored on my email’s mail server allowing me to respond to your query via email or telephone (should you have provided me with a contact telephone number).

Once I have received your email, I will aim to get back to you as possible in order to best deal with your enquiry. I try to only keep emails I deem to be important and allow me to reference any conversations between the both of us, should the need arise in the future. I aim to delete any messages I feel are no longer needed, however, you may request that I delete your personal information and any email correspondence between us from my mailbox so long as I agree I have no valid reason to keep them any longer.

I will also never pass your details onto third party providers or send you any marketing material without first asking you for permission to do this.

If you decide to make a purchase via my online shop, I will be sent a copy of your order via PayPal, which will contain information relating to your order, including the following:

Your name, company name (optional), email address, contact telephone number and your postal address

I will also pass your name and address to shipping couriers in order to post to you your order.

Information that is automatically collected via my website

When using my website, there is information about you that your web browser collects automatically that is used in order for the website to work properly, this includes (sorry if it sounds a bit technical!):

Device IDs or other unique identifiers, device and software characteristics (such as type and configuration), connection information, page view statistics, referral URLS, your IP address (which provides the general location in which you are based) and browser and standard web server log information.

Information from other sources

In some cases, I might need to supplement the information you provide me with information I obtain from other services or data providers. Such supplemental information might include, but is not limited to, looking up your address via Google Maps to find out where you are located should I need to arrange a visit or drop off items.

How do I use your personal information?

I shall only use your personal information based on one of the following reasons:

a)     Consent

You have given me clear consent that you wish me to use your personal data for a specific reason, such processing and shipping an order from my website

b)     Contract

You have entered a contract with me or you have asked me to take specific steps before entering a contract. This could include commissioning me to take on a bespoke art project.

c)      Legal obligation

It is necessary to process your personal information in order to comply with the law

To whom I will disclose your personal information

I aim to disclose your data to as few third parties as possible. However, when you make a purchase via my shop, PayPal will collect your personal details and then send me details with regards to your order. I will then process your order and send your information to a reputable courier in order to dispatch your purchase.

Your information and rights

At any time, it is your right to be able to contact me, either in writing or verbally to request the following:

  • A copy of the personal information that I currently hold about you
  • To ask me to rectify any incomplete or inaccurate information
  • To erase certain aspects of your personal information
  • To restrict how I use your personal information
  • To pass your personal information to another business or organisation where I am technically able to do so

For simple information requests, I will provide a copy of the information free of charge. However, I will charge a fee when a request is:

manifestly unfounded or excessive, particularly if it is repetitive, unless you refuse to respond; or for further copies of the same information (that’s previously been provided).

The fee charged for this is currently £50 per hour, rounded up to the nearest full hour when dealing with non-standard information requests. I will respond to all requests for information within 1 calendar month or sooner whenever possible. However, I can extend this timeframe by a further two months for complex or numerous requests (in which case I will inform you and give an explanation for the extension).

I will verify the identity of the person making the request, using “reasonable means”. This is usually by checking your caller ID if making a request via telephone or receiving the request from a known email address belonging to yourself that I already have on record. I will make you aware of any right of access requests being performed via your nominated email address to ensure any requests are genuine and non-fraudulent.

Security

The security of your data is extremely important to me and wherever possible I use reasonable measures to safeguard your personal information against loss, theft and unauthorized access, use and modification.

Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, I cannot guarantee the complete security of your personal information, but rest assured that I take the security of your data very seriously and have made additional investments to help protect your data to the best of my ability.

Breach notification

The Global Data Protection Legislation requires that I report certain types of personal data breaches to the Information Commissioner’s Office (ICO) and, in some cases, to the individuals affected.

A personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, your personal information.

I have to notify the ICO of a breach unless it is unlikely to result in a risk to the rights and freedoms of any individuals. Where a breach is likely to result in a high risk to your rights and freedoms, I must notify you directly and without undue delay.

Changes to my Privacy Policy

I will update this Privacy Policy from time to time in response to changing legal, regulatory or operational requirements. I will provide notice of any such changes (including when they will take effect) in accordance with law.
